What Employers Should Know About the Updated Form I-9

The United States Citizenship and Immigration Services (USCIS) announced on July 21st a revised Form I-9, which has been simplified and made shorter. Employers are advised to start using this new form from August 1, 2023. However, they can still use the older Form I-9 (Rev. 10/21/19) until October 31, 2023. Beyond that date, using the old form may result in penalties. The new version of the form will be available for download starting from August 1.

According to Greg Berk, an attorney with Sheppard Mullin in Costa Mesa, California, the new I-9 rule acknowledges the prevalence of remote employment and the need to update some of the older I-9 regulations. E-Verify, a robust verification tool, provides more flexibility for employers with remote employees, especially if they are enrolled in E-Verify.
